Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the photomasters.uk website (the "Service") operated by PhotoMasters ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
PhotoMasters provides professional photography services and an informational website about our services. Our services include but are not limited to portrait photography, wedding photography, event photography, commercial photography, and other related photography services.
Some features of the Service may require you to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
All bookings are subject to availability and will be confirmed upon receipt of a signed contract and payment of a non-refundable deposit, which is typically 25% of the total fee. The remaining balance is due no later than 14 days before the scheduled service date, unless otherwise specified in your contract.
Cancellations made more than 30 days before the scheduled service date are eligible for a refund of any amounts paid, minus the non-refundable deposit. Cancellations made less than 30 days before the scheduled service date are not eligible for any refund.
Rescheduling requests must be submitted in writing at least 14 days before the scheduled service date and are subject to availability. A rescheduling fee may apply.
We aim to deliver digital photographs within 4-6 weeks after the service date, unless otherwise specified in your contract. Physical products such as albums and prints may take longer to produce and deliver.
The Service and its original content, features, and functionality are and will remain the exclusive property of PhotoMasters and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of PhotoMasters.
All photographs created by PhotoMasters are protected by copyright law. PhotoMasters retains the copyright to all images created during the provision of our services.
Depending on your specific service agreement, you may be granted a license to use the photographs for personal or commercial purposes, as detailed in your contract. This license does not transfer copyright ownership.
If you provide any content to us (such as testimonials, comments, or feedback), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media.
In no event shall PhotoMasters, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

You agree to defend, indemnify, and hold harmless PhotoMasters and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Service.
Our Service may contain links to third-party websites or services that are not owned or controlled by PhotoMasters. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that PhotoMasters shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
